General Terms and Conditions of AMA Luxe

1. Scope and provider
These terms and conditions apply to all orders placed through the online shop ama-luxe.com. Your contractual partner is AMA Luxe, Auenring 29, 8303 Bassersdorf, Switzerland, email: support@ama-luxe.com (hereinafter “AMA Luxe”, “we” or “us”). Deviating terms of the customer only apply if we expressly agree to them in writing. The version of these terms valid at the time of the order is decisive.

2. Customers
Our offer is aimed at persons of legal age. We only sell perfumes containing alcohol to persons aged 18 and over. By placing an order, you confirm that your details are correct and complete. You are responsible for keeping your customer account login details secure.

3. Products and presentation
We present our products as accurately as possible. Colours and appearance may vary slightly depending on your screen. Natural products such as oud wood or bakhoor may be subject to natural variations in colour, shape and scent; this does not constitute a defect. The presentation of products in the shop is not a legally binding offer but an invitation to place an order.

4. Conclusion of contract
By submitting your order, you make a binding offer to purchase the goods in your cart. We confirm receipt of your order by email. The contract is concluded when we expressly accept the order or ship the goods. We may decline an order in particular if an item is unavailable, there is an obvious pricing or typing error, or payment is not made. In that case, we will refund any amounts already paid without delay.

5. Prices and payment
All prices are final prices in Swiss francs (CHF). Shipping costs are charged in addition according to our Shipping Policy and shown before you complete your order. For deliveries abroad, customs duties, import taxes and fees may apply, which are borne by the recipient. Payment is made using the payment methods offered at checkout and is due when the order is placed.

6. Delivery and transfer of risk
Delivery area, delivery times and shipping costs are set out in our Shipping Policy. Stated delivery times are estimates. For consumers, the risk of accidental loss or deterioration of the goods only passes upon delivery to them.

7. Retention of title
The goods remain the property of AMA Luxe until paid in full, to the extent permitted by applicable law.

8. Right of withdrawal and returns
Information on the statutory right of withdrawal for consumers in the EU and on our voluntary return right can be found in our Withdrawal and Return Policy.

9. Warranty
Statutory warranty rights apply. Please inspect the goods after receipt and report obvious defects, transport damage or incorrect deliveries as soon as possible to support@ama-luxe.com. In the case of justified defects, we will, at our discretion, supply a replacement or refund the purchase price; mandatory statutory rights remain reserved.

10. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for personal injury and under the Swiss Product Liability Act. Otherwise, to the extent permitted by law, our liability is limited to foreseeable damage typical for the contract. We accept no liability for improper use of our products, in particular bakhoor, charcoal and burners. Please observe the safety instructions on the packaging and in the product descriptions.

11. Product safety and use
Our products are not intended for consumption and must be kept out of the reach of children and pets. Burning incense must never be left unattended. If you have sensitive skin or known allergies, we recommend testing perfumes on a small area of skin before use.

12. Intellectual property
All content of the shop, in particular texts, images, logos and trademarks, is protected and the property of AMA Luxe or its licensors. Any use without our prior written consent is prohibited.

13. Reviews and feedback
If you publish reviews or feedback, they must be truthful and must not infringe the rights of third parties. You grant us the free right to publish this content in connection with our shop. We may remove unlawful or offensive content.

14. Platform and data protection
Our shop is operated on the Shopify platform. Purchase contracts are concluded exclusively with AMA Luxe. You can find out how we process personal data in our Privacy Policy.

15. Changes to these terms
We may amend these terms with effect for future orders. The version published at the time of your order applies to your order.

16. Severability
Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall apply in place of the invalid provision.

17. Applicable law and place of jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident abroad, this choice of law only applies to the extent that it does not deprive them of the protection of mandatory provisions of the law of their country of residence. The place of jurisdiction is the registered office of AMA Luxe in Bassersdorf, Switzerland. For consumers, the mandatory statutory places of jurisdiction apply, in particular at their place of residence.
